After 5-4 Birthright Ruling, Trump Tells Congress to Act “TODAY”

Supreme Court hands Trump a narrow loss

The Supreme Court on Tuesday struck down President Trump’s executive order on birthright citizenship in a 5-4 decision. Chief Justice John Roberts wrote the majority opinion, saying children born in the United States to parents who are unlawfully or temporarily present are still citizens at birth under the 14th Amendment. Roberts was joined by Amy Coney Barrett, Elena Kagan, Sonia Sotomayor, and Ketanji Brown Jackson. In other words, the Court took a fight that was already loud and gave it a written opinion, which is one of Washington’s oldest ways of saying the argument is not over.

Trump pushes the fight to Congress

Trump quickly called on Congress to act, saying birthright citizenship is “too bad for our Country,” but can be changed through legislation with the president’s support. He said there is no need for a long constitutional amendment and urged lawmakers to start “TODAY” on what he called an “expensive and unfair” policy. That is the classic federal playbook: when one branch says no, another branch says maybe, and the rest of the country gets to wait while the lawyers sharpen their pencils. Trump said Congress would have his “complete and total support” if it moves ahead.

Trump also points to a bigger win on executive power

In a separate Truth Social post, Trump praised the Court’s decision to overturn Humphrey’s Executor in the Slaughter case, calling it the more important ruling because it gives more power back to the presidency. He said the ruling settled a fight over executive authority that has gone on for nearly 100 years and described the Republican Party as being treated fairly by the Court. Trump also repeated his call for Congress to fix birthright citizenship. So the day brought him one loss and one major win, which is about as close as modern politics gets to balance, even if nobody seems thrilled about the paperwork.
