Rand Paul Boots Fauci’s Lawyer as Fauci Pleads the Fifth

A Subpoena, A Witness, And A Familiar Washington Fog Machine

Dr. Anthony Fauci appeared under subpoena before the Senate Homeland Security and Governmental Affairs Committee for a hearing on the COVID-19 pandemic, and the room did not exactly give off “calm search for truth” energy. Sen. Rand Paul, who has long pressed Fauci over pandemic-era decisions, questioned him as committee chair. Fauci repeatedly invoked his Fifth Amendment right against self-incrimination and declined to answer. According to the hearing exchange, Fauci pointed to Paul’s past public calls for prosecution as part of his reason for fearing legal exposure. In plain English, the former top health official was not interested in giving fresh answers while the legal weather report looked stormy. Washington spent years asking Americans to trust the experts. Now one of the most famous experts in the country was trusting his lawyer.

Paul Removes Fauci’s Attorney From The Witness Table

The hearing grew sharper when Fauci’s attorney, David Schertler, tried several times to address the committee from the witness table. Paul told Schertler he was not recognized, had not been invited to testify, and was not permitted to sit there as a second witness with a law degree. Paul warned him to “sit quietly” and noted that a judge in a courtroom could jail someone for similar behavior. Schertler continued pushing to speak, and Paul ordered security to remove him from the room. The moment was captured on video, which is helpful, since Senate procedure is one of those topics best understood with caffeine, subtitles, and perhaps a mild survival instinct.

Blumenthal Calls It A Vendetta, Paul Says The Rules Are Simple

Sen. Richard Blumenthal of Connecticut objected after the removal and criticized the hearing as a “short-sighted act of desperation.” He argued the process looked more like a vendetta against one person than a serious effort to gather facts. Blumenthal also read from Schertler’s letter, which described Paul’s “years-long public crusade” and cited social media posts about “putting Fauci in jail” as evidence that Fauci had reason to fear prosecution. Paul pushed back, saying “the Fifth Amendment doesn’t work that way.” His point was direct: a witness cannot refuse to testify, then let his attorney testify for him from the same table. Paul said Schertler was out of order and vowed to move forward with a contempt vote over Fauci’s broad refusal to answer questions.
