Rep. Ilhan Omar has portrayed the search of her Washington, D.C., home as political persecution by a “vengeful” President Trump. That storyline took a serious hit after CNN reported that federal prosecutors had to obtain approval from a federal magistrate judge before searching the residence.
CNN identified Judge Matthew Sharbaugh of the D.C. District Court as the judge who approved the warrant. The report said Sharbaugh limited how the Justice Department could access Omar’s documents because of her position as a member of Congress and the constitutional protections attached to that role. Apparently, even a dramatic raid still requires a warrant, a judge, and legal limits. How inconvenient for anyone hoping to frame the entire episode as a presidential vendetta.
The revelation matched suspicions previously raised by Article III Project founder and former Senate Judiciary Committee counsel Mike Davis. Davis had pointed to the D.C. U.S. District Court’s public schedule, which showed Sharbaugh serving as the magistrate on criminal duty from October 3 through October 16, 2026, the period covering the search. There was a small possibility that the judge could have been unavailable, but CNN’s report identified him as the official who handled the warrant.
Sharbaugh’s background has also drawn attention. In a Fox News opinion article, Davis wrote, “Before becoming a judge, Sharbaugh donated to Hillary Clinton during her losing 2016 campaign against President Trump.” Davis also noted that Sharbaugh clerked twice for Judge Robert Wilkins, an Obama-appointed judge, serving both on the D.C. District Court and the D.C. Circuit.
Davis further argued that Sharbaugh has previously ruled against the Trump Administration in notable matters. He pointed to an August decision in which Sharbaugh released a woman accused of deliberately defacing the World War II Memorial, allowing her to leave custody on a personal recognizance bond despite arguments from the Justice Department.
The search itself was reported as part of an ongoing criminal investigation into Omar’s immigration paperwork. The Gateway Pundit reported that federal agents raided the Washington, D.C.-area residence early Monday morning, with multiple agents wearing HSI jackets observed outside around 6 a.m. The paperwork at issue was reportedly completed by Omar’s late father when she was a child.
According to Omar’s website, she arrived in the United States in March 1995 at age 12 after spending approximately four years in a refugee camp in Kenya. She became a naturalized U.S. citizen in 2000 at age 17. Those details remain central to the investigation described in the report, while Omar continues to plead innocence and accuse President Trump of persecution. The newly identified warrant process, however, makes the claim of a direct presidential vendetta look considerably less convincing.
