Trump Shared the Report, but Added No Comment
President Donald Trump on Sunday evening shared a Just the News report on Truth Social about Immigration and Customs Enforcement refusing to release records tied to Rep. Ilhan Omar of Minnesota. He did not add his own commentary, which leaves the usual Washington guessing game to do what it does best: turn silence into a full-time occupation. The report centered on a Freedom of Information Act request seeking documents related to any ICE investigations into long-running allegations involving Omar’s immigration history and a past marriage. The key fact is not that Trump wrote a new accusation. He did not. The key fact is that ICE declined to release records and pointed to a law-enforcement exemption.
ICE Pointed to a Law-Enforcement Exemption
Just the News filed the FOIA request in January for documents related to any ICE investigations into alleged immigration fraud. ICE refused to turn over the records, citing 5 U.S.C. § 552(b)(7)(A), which protects law-enforcement material when disclosure could interfere with an investigation or proceeding. ICE wrote, “Disclosure of any responsive records at this time could reasonably be expected to interfere with enforcement proceedings.” That sentence is doing a lot of work. Still, ICE has not publicly identified the precise proceeding, announced charges, or confirmed that removal proceedings have formally begun against Omar. In other words, the agency has raised the curtain an inch, then asked everyone not to notice the stagehands.
The Allegation Remains Disputed
The allegations involve Omar’s 2009 legal marriage to Ahmed Nur Said Elmi, who has been alleged by critics to be her biological brother. Omar has repeatedly denied the accusation. She filed for divorce from Elmi in 2017. The central claim that Elmi is her biological brother has not been established in court, and no publicly released DNA evidence or judicial finding has conclusively proven it. Omar, who was born in Somalia, arrived in the United States in 1995 and became a citizen in 2000. She has called the accusation a “bigoted lie,” said she committed no crime, and said she would cooperate with an investigation. Those denials matter, even if bureaucracy now appears unwilling to simply close the file with a polite rubber stamp.
Homan and Vance Previously Said Reviews Were Underway
The Gateway Pundit previously reported that Tom Homan said in December that he had ordered Omar’s immigration records pulled for review. “We’re pulling the records, we’re pulling the files, and we’re looking at it,” Homan said. He also said an experienced Homeland Security Investigations fraud investigator had reviewed the file before and raised concerns about possible fraud. In March, Vice President JD Vance said the White House fraud task force was examining the allegations, saying, “We actually think that Ilhan Omar definitely committed immigration fraud against the United States of America,” according to prior Gateway Pundit reporting. Two months later, Vance said the Justice Department was also reviewing the controversy, while cautioning that he did not want to prejudge the investigation. “If we think that there’s a crime, we’re going to prosecute that crime,” he said.
Records Fight Puts the Old Dismissals Under Pressure
For years, Omar’s defenders dismissed questions about her marital and immigration history as a right-wing conspiracy theory. Now ICE is invoking a federal law-enforcement exemption and saying release of records could interfere with enforcement proceedings. That does not prove the allegations. It also does not look like a routine “nothing to see here” response from an agency famous for making simple paperwork feel like a hostage negotiation. The known facts are narrower but important: a FOIA request was filed, ICE refused release under a specific statute, and Omar continues to deny wrongdoing. The rest now depends on whether federal officials ever produce records, charges, or findings instead of the usual fog machine set to maximum.
