Civil Case Moves Ahead
A Los Angeles Superior Court judge has ruled that a civil lawsuit tied to the 2021 Rust shooting can move forward, keeping Alec Baldwin in the legal spotlight for a case that has already gone through more than one court. The lawsuit was filed by Serge Svetnoy, a lighting technician who says he was nearly struck by a bullet on set and later suffered emotional distress. The shooting killed cinematographer Halyna Hutchins and injured director Joel Souza, turning a movie set into a scene that no one involved will likely forget. The court ruling does not decide blame, but it does mean a jury may eventually hear claims that this tragedy was tied to serious negligence.
What The Plaintiff Says
Svetnoy first filed his lawsuit in November 2021. He argues that the production was marked by cost-cutting and unsafe choices, and that Baldwin, armorer Hannah Gutierrez-Reed, and other producers were aware of the risks but did not stop them. Los Angeles Superior Court Judge Maurice Leiter allowed claims for negligence, punitive damages, and intentional infliction of emotional distress to proceed. That is legal language for a simple point: if a set is run on shortcuts, someone may have to answer for the fallout. The complaint says the harm was not just physical, but emotional too, which is often what happens when safety gets treated like a line item instead of a must-have.
Criminal Case Left Its Own Mark
Baldwin also faced criminal charges in Santa Fe over Hutchins’ death, with prosecutors filing two counts of involuntary manslaughter. In July 2024, Judge Mary Marlowe Sommer dismissed that case with prejudice, which means it cannot be brought again. Baldwin’s defense said prosecutors hid evidence, and the judge ended the case during trial. The dismissal did not erase the death or the broader questions around how the production was handled. It just added another layer to the legal mess, because in modern America one courtroom is never enough when paperwork can have a sequel.
