Fernando Cluster went to Emory University Hospital Midtown in September 2022 for what was supposed to be a routine procedure. He was diagnosed with an intracerebral hemorrhage, more commonly known as a brain bleed, which sounds serious—and it is! Doctors decided that removing a sizeable piece of his skull—about 4.7 by 6 inches—was necessary to alleviate pressure on his brain.

Fast forward two months later; Fernando returned to the hospital, ready for the much-anticipated surgery to replace the piece of skull they had removed. But here’s where things took a dramatic turn. The hospital staff couldn’t find his skull fragment! Instead, they discovered it was lost among other unidentified bone fragments from previous patients. Imagine being told your own body part is MIA amidst others! Talk about adding insult to injury.

A note from the hospital staff left in Cluster’s medical file revealed their shocking discovery: “We inspected the freezer where bone flaps are stored and could not find a bone flap with Mr. Cluster’s patient identification.” They were left sifting through several bone fragments without any clue as to which belonged to him. How does something like this even happen?

From Bad to Worse: The Price of Negligence

As if things couldn’t get any more outrageous, Fernando’s total medical bill skyrocketed past $146,800! And guess what? The hospital allegedly didn’t offer him or his wife any discounts for their negligence throughout this entire ordeal. It seems like Emory University Hospital might need some lessons in customer service—or just basic human decency!

A Call for Justice: Seeking Compensation

This jaw-dropping saga doesn’t stop there. Fernando and his wife are now seeking compensation from the hospital for their immense medical bills as well as emotional damages incurred due to this shocking incident. Their attorney Chloe Dallaire expressed how upset her clients are about being billed after such careless treatment from Emory Hospital. She stated emphatically that their focus lies primarily on “the egregiousness of Emory losing a part of [Fernando’s] body and then having a flippant attitude about it afterwards.”
