The decision came in federal immigration court and applied despite Flores-Miguel’s long removal history. The judge cited legal limits on immigration detention and due process concerns.
The Man Arrested
ICE arrested Flores-Miguel in a Minneapolis raid on January 20. Authorities say he is an MS-13 member who had been deported four times and has convictions for sexual assault and robbery. During the arrest he allegedly punched and kicked ICE officers and grabbed an officer’s gun holster, officials reported.
How He Got Out Before
DHS records say Flores-Miguel was released into the United States under the Biden administration in 2022 after prior removals. This is not an isolated case. Another federal judge recently ordered the release of MS-13 member Kilmar Abrego Garcia. Critics say routine releases like these show gaps in immigration enforcement and in detention rules.
Officials Push Back
Acting DHS officials blasted the decision. Lauren Bis called the release reckless and warned released detainees could commit new crimes. ICE had described Flores-Miguel as a dangerous repeat offender when it publicized the January arrest. They urged faster court proceedings and more cooperation with border enforcement.
A Pattern of Releases
Judges weigh liberty against government detention authority. That balancing act has led to several ordered releases this year, sparking calls in Congress and from immigration officials for clearer rules and faster deportations.
